The appeal comes after months of back-and-forth legal battles, and at the heart of it lies what Chiles and her legal team argue is a deeply flawed arbitration process that unfairly cost her the Olympic medal she rightfully earned.

The CAS Ruling and the Dispute Over Timing

The dispute centers on the individual floor exercise competition, which took place on August 5, 2024, in Paris. Chiles, who had already secured a gold medal with Team USA in the all-around event, competed individually on the floor and initially finished in fifth place. However, after reviewing the judges’ scores, Chiles’ coach noticed what they believed was an error in the scoring system. They submitted an inquiry to correct her score from 13.766 to 13.666, a difference that would have elevated Chiles to third place, earning her a bronze medal.

However, shortly afterward, Romanian gymnast Ana Bărbosu’s team filed their own appeal, challenging the timing of Chiles’ inquiry. This ruling ultimately stripped Chiles of her bronze medal, which was then awarded to Bărbosu.

This connection, they say, created a serious conflict of interest, as Gharavi was overseeing a case that directly impacted Romanian gymnast Ana Bărbosu, who ultimately benefited from the CAS ruling.

The failure to disclose this conflict, according to Chiles’ lawyers, undermined the fairness of the arbitration process. They argue that if this information had been made known, Gharavi would have been disqualified from presiding over the case due to his potential bias in favor of Romania.

In the press release announcing the appeal, Chiles’ legal team emphasized that this conflict of interest was a fundamental violation of Chiles’ rights and further proof that the CAS ruling was unfairly decided.

A Call for Fair Play in the Olympic Arena

Maurice M. Suh, one of Chiles’ attorneys, framed the appeal as an opportunity for the international community to take a stand for fairness and justice in Olympic competition. In a statement, Suh questioned whether the world would tolerate an athlete being stripped of her rightful achievements due to an unfair arbitration process.

“Jordan Chiles’ appeals present the international community with an easy legal question — will everyone stand by while an Olympic athlete who has done only the right thing is stripped of her medal because of fundamental unfairness in an ad-hoc arbitration process? The answer to that question should be no. Every part of the Olympics, including the arbitration process, should stand for fair play,” Suh said.

The statement speaks to the broader implications of the case, which could set a precedent for how arbitration processes are conducted in the future. Chiles’ legal team is urging the court to prioritize transparency and integrity in its review of the case.

Support from the US Olympic Committee and USA Gymnastics

Jordan Chiles is not alone in her fight. Her appeal has received strong backing from key organizations in the American gymnastics and Olympic communities. The United States Olympic and Paralympic Committee (USOPC) has formally supported her appeal, filing a letter of endorsement with the Swiss Federal Court.

USA Gymnastics (USAG), the governing body for the sport in the United States, has also thrown its support behind Chiles. In a statement released on Monday, USAG expressed its full backing of Chiles’ efforts to overturn the CAS ruling.

“USA Gymnastics supports the appeal submitted today by Jordan Chiles at the Swiss Federal Tribunal as we made a collective, strategic decision to have Jordan lead the initial filing,” the statement read. “USAG is closely coordinating with Jordan and her legal team and will make supportive filings with the court in the continued pursuit of justice for Jordan.”

The coordinated efforts of USOPC and USAG show the level of confidence these organizations have in Chiles’ case and highlight the importance of ensuring fairness in all Olympic proceedings.

In her post, Chiles explained that she had full confidence in the appeal led by USA Gymnastics, which had provided what she believed to be conclusive evidence supporting her case. “I have no words. This decision feels unjust and comes as a significant blow, not just to me, but to everyone who has championed my journey,” Chiles added.
